Once graduating from law school in the early 1990s, I vowed to become the best criminal defense attorney I could become.

I have tried over 200 jury trials and handled every criminal case you can think of regarding criminal defense. I have traveled throughout the United States, defending clients for federal crimes, and am well-known in Los Angeles.

I am a former J.N.E. Commissioner (involved with investigating attorneys who want to be appointed as judges by the Governor). Early in my career, I worked for the Los Angeles County District Attorney's Office in East L.A. and for a Superior Court Judge in Burbank as his right-hand man.

This experience has given me a well-rounded perspective on the criminal justice system, part of my goal of mastering criminal defense. I have lectured at colleges and written a book called The Art of the Perfect Defense to try to make criminal defense in Los Angeles more understandable and not this scary thing that people do not even know how to begin to deal with.

What is a Consultation Meant for?

One big thing that comes up is that I think people get confused about the purpose of a consultation regarding potentially hiring a criminal defense attorney. They, of course, see that it's free. So, some people try to use a consultant to solve their problems.

They're not looking to hire a criminal defense attorney; they want to talk to one to see if they can figure out that their case is not a good one against them and solve their problem over the phone.

There are better uses for a free consultation. The purpose of the consultation is to talk to an attorney, get an idea of what you're facing, and determine whether or not that attorney is the one you want to hire.

So, it would be best if you weren't talking to attorneys over the phone about criminal cases unless you're thinking about hiring them because what's likely to happen is that someone might give you advice without having all of the facts and details. So now you're working with bad advice, and you might do something that causes you to end up in a worse position.

An attorney should only tell you how to handle the case once they have all the facts. First, they need to talk to you about it. Second, they need to look at all of the evidence in the case. Third, they need to speak to the prosecutor about the issue. Finally, they may even need to look into the matter before letting you know.

So, I don't get involved in consultations where I can tell the person is just trying to solve their matter over the phone when I need all the details. It doesn't make sense.

I don't want to give somebody advice when I have half-baked information. Usually, the information I'm getting is the skin that a particular person who doesn't want to get in trouble is telling me. They tend to leave things out or downplay essential things necessary to decide whether or not the case makes sense to fight.

Whether it makes sense to negotiate the case and whether it looks like the prosecutors will file it. I'm always hired to profile criminal cases before they are filed. I will help the person make the right moves, do any necessary investigation, and talk to the police about the case.

If there's a prosecutor on the case, I can talk to the prosecutor to try to get a leg up on your criminal case and handle it the right way.
