The third thing we must look at is whether this is someone trying to kill another person because, for attempted murder, you have to have a specific intent to kill.
Case Example
I recently got a case dismissed where the charges were attempted murder, where my client shouted at his significant other that he would kill them both. They were driving a car, and sometime after that, the vehicle crashed into a wall, and they both sustained severe injuries.
Maybe at face value, you think he's guilty; he must have done it because he said he would kill them both, and then the car crashed. However, once the case was broken down, you realize he did not intentionally crash the car into the wall.
He lost control of it while talking to somebody else, and that's not attempted murder because he didn't have the specific intent to kill. So, we were able to get that charge dismissed.
That's just one example of the many attempted murder charges I've been dismissed over the years. Still, we must have the facts and circumstances to attack a case and get that not-guilty verdict.
In this case, I was able to convince the lead prosecutor that they were going to lose that case at trial. They should give my client some other charge. We got the client out of custody and avoided that potential 15 to life that comes along with premeditated attempted murder.
