Winning Strategy for Attempted Murder Charges in Los Angeles

If you or a loved one is charged with California Penal Code 664/187 PC attempted murder in Los Angeles County, you're probably in one of the 30 courts and looking for an attorney to assist you. 

I've been doing this now for over 30 years.  I've handled many cases just like the one you or your loved one faces.  I encourage you to look at the attorneys you are considering hiring carefully.

First, ensure that that attorney will be in charge of your or your loved one's case.  I'm seeing many law firms that put what I characterize as a figurehead attorney on their websites, but they don't practice and go to court.  All they do is assign the case to a lesser attorney who does not have the skills you or your loved one will need.

The second thing is you have to get an idea of whether or not it's a case you can fight at trial or a case you can resolve.  That's where we start talking about some winning strategies in defending attempted murder charges. 

When it comes to attempted murder, you must consider whether they have the right person.  Is it a “who done it” identification case where they can't prove that you or your loved one was the person who committed the crime that triggered the attempted murder charges?

The third thing we must look at is whether this is someone trying to kill another person because, for attempted murder, you have to have a specific intent to kill.

Case Example

 I recently got a case dismissed where the charges were attempted murder, where my client shouted at his significant other that he would kill them both.  They were driving a car, and sometime after that, the vehicle crashed into a wall, and they both sustained severe injuries. 

Maybe at face value, you think he's guilty; he must have done it because he said he would kill them both, and then the car crashed.  However, once the case was broken down, you realize he did not intentionally crash the car into the wall. 

He lost control of it while talking to somebody else, and that's not attempted murder because he didn't have the specific intent to kill. So, we were able to get that charge dismissed. 

That's just one example of the many attempted murder charges I've been dismissed over the years. Still, we must have the facts and circumstances to attack a case and get that not-guilty verdict.

In this case, I was able to convince the lead prosecutor that they were going to lose that case at trial.  They should give my client some other charge.  We got the client out of custody and avoided that potential 15 to life that comes along with premeditated attempted murder.
