Can Bodycam Evidence be Used to Dismiss a Criminal Case?

I continue to speak on this and I think people are going to realize it more and more, that the police are really not that smart and this whole introduction of bodycam evidence has really thrown them for a loop.

You realize you've got people who are not putting two and two together.  They're continuing to write the same police reports where they jimmy-up crimes against people and where they jimmy-up illegal stops against people.

Also, they claim things happened that didn't happen and they're not mentally used to the fact that not only do they have a bodycam on that's capturing a lot of an incident, but other fellow officers have bodycam on that's capturing the same incident.

In some criminal cases, we can file a motion to dismiss in court.

So, I see them all the time coming up to their fellow officers with their bodycam on, saying I've got my bodycam on.  So, they're trying to figure it out, but I just got an email today from a prosecutor saying they're going to dismiss the case against my client.

This was because I requested the bodycam evidence that they claim they should have but it's not booked into property and the prosecutors, too, are starting to see that these guys don't always tell the truth. So, this case is going to get dismissed and it's because of the bodycam evidence.

In this case, not only did it look suspicious that a piece of evidence went missing, but now they had to turn over to me that the same police officer that claimed certain things, has a prior incident where he claimed something and then they looked at the bodycam and he was not telling the truth.

They had to turn that over in discovery.  That's why they're dismissing this case against my client because they realize I will use that in a Motion to Dismiss the case with the judge to show that he is lying once again.

Issues with Actually Proving a Lie

It's just a shame that this is happening — that people continue to lie.  I'll tell you, I've been doing this for 26 years and I've realized this was happening my whole career. The problem is you just can't always prove it.  I have clients tell me the same thing over and over again.

There's no reason for them to lie to me, most of the time, because I'm just trying to help them, plus, I'm reading between the lines looking at the evidence and it's not making sense.

But, how do you prove it?  It's going to be my client's word against the police officer's, and a lot of times my clients are caught with something illegal or caught doing something illegal, so the judge tends not to believe them.

But now, the pendulum is starting to swing in the favor of justice because of this bodycam evidence.  I can't tell you how many times I've been able to use the bodycam evidence to be able to prove something that I couldn't prove without it.
