| Suspect Found in Fatal Shooting of 3-Year-Old Girl |

Authorities arrested a suspect in the shooting of two 3 year old girls and a pregnant woman. The 19-year-old man fired shots at a crowded front porch on Monday allegedly out of revenge. One of the 3-year-old girls died, the other 3-year-old and her pregnant mother were injured. According to reports, an hour before the incident, a Good Samaritan saw the suspect beating up a woman and interfered, allowing the woman to escape.
"We're happy, of course. This individual can't hurt anybody else," said John Prendergast of Hesperia, the uncle of La-Donna Howie, the 21-year-old pregnant mother who was shot. "To shoot a little child, this guy has no conscience whatsoever."
According to Prendergast, the family was told by investigators that video surveillance from a security camera at a nearby store helped them identify the suspect. The video caught the suspect beating the other woman and the the Good Samaritan who saved her.
"They found the girlfriend first, and they were working on her to give information about the guy, but she didn't want to at first," Prendergast said. "I guess that changed."

| Reward for Information on Giants Fan Attackers Raised to $100,000 |
| Posted By Admin |
 |
The reward being offered for information on the suspects who attacked a Giants fan was raised from $50,000 to $100,000 after the Los Angeles City Council voted to offer $50,000. Bryan Stow received life threatening injuries after being attacked last Thursday after the Dodger season opener.
Los Angeles County Supervisor Mike Antonovich offered a $10,000 reward, the San Francisco Giants offered $10,000 and American Medical Response, the company where Stow works, offered $5,000. The Dodger then matched those rewards and pledged a $25,000 reward on Monday.
Stow is a father of two from Santa Cruz. He was one of three Giants fans attacked after Thursday's game. According to police, the suspects kicked and punched the victims, shouting expletives about the Giants as they delivered the blows. Police said the attack was unprovoked.
Councilman Ed Reyes said in a statement that the incident was cause for the dodgers to reevaluate their policies regarding alcohol sales and post-game security.
"I hope the Dodgers will step forward and add to the reward," Councilman Dennis Zine said.

| Volunteer Youth Counselor Arrested for Having a Sexual Relationship with a Minor |
| Posted By Admin |
 |
A volunteer youth church counselor is facing multiple counts of sex crimes against a minor. Marcellino Tinajero, 33, was arrested late last month, after the parents of a 16 year old girl filed a crime report against him. According to investigators, Tinajero met the girl while he was a volunteer youth counselor with Shepherd of the Hills Church in Porter Ranch. "At this point that's the only child that has come forward," said Det. Michael Brox from the LAPD. "The purpose of this conference is to reach out, and the photographs we have for the purposes of people to look back and draw on their memories to see if they had any contact with this individual in the past."
According to investigators, Tinajero was a member of the church for almost a year and a half, and had engaged in an alleged sexual relationship with the minor for about six months. "That volunteer was dismissed immediately once the church was made aware of the allegations," said Pastor Winters. "The church has also conducted an investigation and believes there is no continuing risk to anyone who attends our church." He said the church did the necessary criminal background check before allowing Tinajero to serve as a youth counselor and everything came back fine.

Three 18 year old men and two juveniles were arrested on suspicion of committing a rash of paintball assaults. They could face felony assault charges. The group shot at a girl on a bike, seniors, and a 16-year-old boy. According to Lt. Jay Hawver, the victims did not provide very good descriptions of the perpetrators, but the vehicle descriptions did help in catching the men. "It's very shocking when someone is hit, and victims don't pick up on the things," Hawver said. "We need them to notice like good solid descriptions or license plate numbers. The vehicle descriptions helped out tremendously based on the sheer number of victims."
Julian Stephens, Kevin Yuenyongsukal, and Eric Monson, the adults, were all booked on conspiracy to commit assault with a deadly weapon and held at Burbank Jail. They were released on $60,000 bail.

| The Death Penalty May Face More Changes and Regulations |
| Posted By Admin |
 |
The only U.S. maker of the anesthetic used in executions announced Friday that it will stop manufacturing sodium thiopental. Discontinuing the drug in California will cause the state to revise laws governing executions and those seeking supplies from foreign makers may be turned away by countries that condemn capital punishment.
According to Elisabeth Semel, a UC Berkeley law professor, the state's new protocols specify use of sodium thiopental as the first drug in the three-injection sequence, and any substitution would require the state to again revise the protocols.
Kent Scheidegger, legal director of the Criminal Justice Legal Foundation, said, "Long-term, I expect that the states will follow the lead of Oklahoma and switch to another drug without a supply problem. Short-term, this requires going through the cumbersome regulation process with comment-spamming by the anti-death-penalty crowd." He suggests that the California Department of Corrections and Rehabilitation start the legal revision immediately "so as to have it completed before an actual supply problem delays and denies justice again."
According to Richard Dieter, director of the Death Penalty Information Center, said states with the death penalty will now have to turn to a different anesthetic or seek sodium thiopental from a foreign supplier, "both of which have pitfalls."
U.S. District Judge Jeremy Fogel has been reviewing California's new lethal injection procedures and is expected to rule soon on whether they comply with the Constitution's ban on cruel and unusual punishment.

$600 worth of Christmas decorations were stolen from Patricia Castenada's front yard last Friday morning. The thieves took two Snoopy Christmas ornaments, a 3 ft. tall "Flintstones" Dino character & a 4-foot-tall gingerbread house. Although the decorations were "not real valuable," it's "just a nasty thing to do at this time of the year," said Sgt. John Hauck of the Los Angeles County Sheriff's department's Carson station.
Sgt. Hauck suggested placing decorations as close to the house as possible and motion detector lights. "Really, it's not as common as you might think," Hauck said. "Once every year, someone has a loss like that."

| IS LOS ANGELES COUNTY JAIL LETTING PEOPLE GO TOO EARLY? |
| Posted By Admin |
 |
Over the course of the past 5 years, I have seen a huge shift in the amount of actual custody time people are serving on Los Angeles jail sentences. Because of budget cuts, the Los Angeles County Sheriffs Department has taken matters into their own hands. They have been systematically letting people go early on just about all jail sentences in Los Angeles County.
The rationale behind letting inmates out early apparently relates to not having enough deputies to staff the jail. Further, this practice permits the Sheriff to save money on food and every other cost related to housing inmates. Prosecutors and judges have adjusted their sentencing practices because they too know that their jail sentences are simply not being served. Their standard line is, "it is not our problem if the jails let the inmates go early...we are not going to consider that in what we decide the sentence is going to be."
This of course is not true. They do and say things all the time that make it clear they are trying to craft a sentence to get around the Los Angeles' sheriffs policy of letting inmates go early.
I have seen them give cal trans instead of jail, because they know that the person will actually have to do the cal trans. I have seen them keep a person in custody and then sentence them after they feel the person has served enough time. In more serious cases, they offer prison time instead of a county jail sentence, because they know that the person will not serve enough time in the county jail.
The bad economy and budget cuts have continued to effect every aspect of our lives. It is imperative that Sacramento deal with the budget issues immediately. There are issues being argued in the Supreme Court, as of this writing, related to releasing thousands of inmates because of the harsh conditions and overcrowding in state prisons as well.

| Police are Investigating a Fire that Broke out in a Building for Possible Illegal Marijuana Cultivation |
| Posted By Admin |
 |
An overnight fire in a Sun Valley commercial building is being investigated and said to contain substantial stores of marijuana. The tenants are described by their neighbors as friendly, but secretive and security conscious. The fire call came in at 11:44 p.m. Saturday and firefighters immediately alerted police investigators when they discovered the marijuana. Sgt. David Tomilin of the Los Angeles Police Department's Foothill Division said "A lot of marijuana had been burned, but I'm not sure how much went up in smoke." Officers booked more than 100 pounds into evidence Sunday morning.
Investigators could not yet call the operation illegal, since marijuana for medical purposes can be grown and distributed legally. "I don't know if they had some kind of licensing," said Tomilin. "It's obviously not for personal use based on the amount. The stuff we could book was in trash cans in 30 to 40 pound bags."
An early wire-service report quoted a police investigator as saying that the fire was started by a high-wattage bulb frequently used to grow marijuana indoors, but authorities backed away from that conclusion pending further investigation.
According to Health & Safety code 11358, Anyone who plants, cultivates, harvests, dries, or processes any marijuana or any part therof, except as otherwise provided by law, shall be punished by imprisonment in the state prison.
If you or someone you know is facing marijuana cultivation charges it is important to hire a experienced criminal defense attorney. Contact the Hedding law firm today and set up a free face-to-face consultation. Our attorneys have a combined 75 years of experience in these types of cases. | 9th Circuit Court Rules Police Must Have Reasonable Grounds to Use Tasers |
| Posted By Admin |
 |
As a result of a excessive force ruling by the U.S. 9th Circuit Court of Appeals, implications may arise for use of force policies across the West. A federal appeals court ruled Tuesday that a Coronado, Calif., police officer used excessive force when he shot a Taser dart at a young driver who was stopped for a seat belt violation. The driver, Carl Bryan, fell to the asphalt after being stuck by the dart, broke four teeth, and suffered facial cuts. He went on to sue the Coronado Police Department and Officer Brian MacPherson.
The appeals panel said police must have reasonable grounds for using a Taser on a suspect. Bryan was wearing only boxer shorts and tennis shoes and was clearly unarmed. Bryan was standing about 20 feet away with his back to MacPherson when he was hit.
While the appeals panel deemed the Taser use excessive and unjustified, they decided that the officer deserved immunity from prosecution because the circumstances in which the weapon could be reasonably deployed were not clearly defined at the time.
According to Boehmer, MacPherson attorney, due to the immunity grant, Coronado will not appeal the excessive force ruling and would work with police to establish guidelines for the weapon.
If you feel that you were illegally stopped and as a result you are facing criminal charges, contact our office today to set up a free face-to-face consultation. Angelina Everett was sentenced to 90 days in jail after a hit-and-run conviction. Cycling activists are celebrating the verdict after the Los Angeles County District Attorney's office and the City Attorneys office at first declined to press charges. An organized protest ride took place on Feb. 24th tracing the route the victim, Ed Magos, would take every morning. The next day Los Angeles police chief, Charlie Beck, responded to the protests in a news conference where he promised a new investigation into the crash. The city attorney's office later decided to take up the case. Bicycle activists have fought for harsher punishments for motorists who hit cyclists. "Cyclists need to be considered viable users of the road, and drivers need to ensure the safety of everyone on the road," said Aurisha Smolarski of the Los Angeles COunty Bicycle Coalition. Superior Court Judge Elaine Mandel sentenced Everett to 90 days in jail and she will also have to pay restitution of nearly $20,000 to cover Magos' medical expenses and lost wages.

Nicolas Perez, 39, has been charged with producing thousands of counterfeit True Religion jeans and other apparel knockoffs at a factory in Lynnwood and illegally selling the items in Santee Alley in downtown Los Angeles and other areas of Southern California. He faces a max sentence of 3 years in state prison and a $250,000 fine if convicted.
According to Kris Buckner of Investigative consultants the factory came to the attention of authorities several weeks ago. They then went undercover and found the factory was producing massive amounts of knockoffs merchandise. "There were over 1,000 finished items and tens of thousands of trim items, including buttons, patches, labels and rivets," Buckner said. He said the find was odd considering the amount of equipment in the factory. "It's the biggest manufacturing facility I've seen in the last 10 years," Buckner said. The factory was allegedly making T-shirts and high-quality polo shirts with brandnames that included Lacoste, Bebe, Affliction, Ed Hardy, Abercrombie & Fitch, Hollister and Nike. Perez is being held in lieu of $20,000 bail at the North County Correctional Facility.

| Prosecutors Reject Drug Case Against Rapper T.I. |
| Posted By Admin |
 |
The Los Angeles County District Attorney's office declined to file criminal charges against Grammy award-winning rapper T.I., citing his federal prison sentence on a probation violation.
This past September, T.I. and his wife, Tameka Cottle, were in their vehicle when they were stopped by Los Angeles county deputies. During the traffic stop, deputies smelled marijuana coming from their vehicle. While searching for the source of the odor, deputies found four ecstasy pills in the rapper's pants. T.I and his wife were later booked at the West Hollywood sheriffs station on drug-possession charges. The rapper was on probation after serving seven months in prison on weapons charges.
The prosecutors rejected the case, citing the federal 11 month prison sentence given to the rapper for violating the terms of his probation, stemming from his September arrest. T.I. faced a 30 year prison sentence in 2007 after an arrest on federal gun charges.
If you or a loved one is being charged with drug charges, a Los Angeles criminal attorney who specializes in drug possession cases is key for your case. | Los Angeles County Sheriff Lee Baca Opposes Proposition Legalizing Marijuana Related Activities |
| Posted By Admin |
 |
Los Angeles county Sheriff, Lee Baca, stated during a news conference Friday that his deputies' Marijuana enforcement would not change regardless if Proposition 19 passed or not. Baca stated that the proposition was superseded by federal law and if passed, would be found unconstitutional. When Baca was asked if he had ever experimented with the drug, Baca replied, "Hell no." According to Baca, legalizing Marijuana would have many repercussions, such as increasing the costs of drug rehabilitation, causing traffic accidents, prompting labor disputes with employees under the influence on the job and will assist drug cartels selling harder narcotics by providing a safe cover. Baca said personal users smoking in their homes are not a priority for police agencies, "if you want to do a joint in your house, do it. Leave the rest of us alone." Baca said. Baca encourages local law enforcement agencies to abide by federal drug laws prohibiting marijuana even if Proposition 19 passes.
If Proposition 19 is approved, marijuana-related activities will be legalized, local governments will be allowed to regulate these activities, local governments will be able to impose and collect marijuana-related fees and taxes, and authorize various criminal and civil penalties.

 |
The one thing you don't want to do in Los Angeles is mess with the traffic. Imperial Stars, a country music band, decided to park its truck diagonally across three lanes of southbound traffic on the 101 freeway, hop out and throw a surprise concert. The three band members got on top of their truck and performed a song called "Traffic Jam 101." The three musicians were arrested and are facing misdemeanor conspiracy charges. All three musicians were released from Los Angeles County Jail after each posting $10,000 bail. The concert caused a big traffic jam and many people reported that it added an hour to their commute.
The criminal act of conspiracy involves an agreement between two or more persons to break the law at some time in the future. There isn't a limit on the number of people participating in the conspiracy, and others can join in the act later and still incur joint liability and conspiracy. The actual crime does not have to be completed in order to face a conspiracy charge, but there must be proof that there was intention to break the law.

One of the biggest arguments supporters of the proposition were using was that the criminal penalties for owning marijuana can seem too harsh, and that people caught with small amounts of marijuana shouldn’t have their lives ruined because of it.
On October 1st however, Gov. Schwarzenegger signed into law Senate Bill 1449, which will reduce the punishment for possession of an ounce of marijuana from a misdemeanor to an infraction. If caught with less than one ounce of marijuana there will be a fine of $100, but those who receive citations will no longer sit for a jury trial and will not carry a criminal record. This new law might weaken one of the strongest arguments of Proposition 19 supporters

| Schwarzenegger Signs Bill Allowing Medical Parole |
| Posted By Admin |
 |
Governor Schwarzenegger signed a bill Tuesday allowing the state to parole comatose and physically incapacitated inmates. Under the measure, state prisons will be able to release comatose and physically incapacitated inmates on medical parole. According to the governor the bill requires a screening process to ensure public safety. "The state currently wastes millions of dollars guarding physically incapacitated inmates in comas or in similar conditions that pose no threat to the safety of others," Schwarzenegger said.
According to a court-appointed federal healthcare receiver for the state prison system, thirty-two inmates are expected to be immediate candidates for medical parole. Of those thirty-two, 21 are housed in nursing homes or hospitals. Sen. Mark Leno (D-San Francisco) said that eventually up to 1,000 inmates may be eligible for medical parole. The measure was approved over the objection of some Republican lawmakers who argued that it might result in the release of too many inmates to cut costs. Schwarzenegger responded by stating that any release would have to be approved by the state Board of Parole Hearings, and offenders sentenced to death or life without parole would not qualify.

On Friday a girl told the San Diego county sheriff’s department that she was abducted and sexually assaulted by three men. Over the weekend composite drawings of the alleged attackers were released. | DNA Testing Clears a Man Convicted of Rape |
| Posted By Admin |
 |
|
258 people have been exonerated by DNA testing, pressuring criminologists to find out what exactly went wrong in those cases. A big focus is being put on faulty eyewitness testimony. Over 75% of these men were convicted in part because someone pointed to the wrong person. An even more interesting fact is that in all cases where the eyewitness was wrong, the real perpetrator wasn't in the initial line-up. This raises a huge question; can eyewitness testimony be trusted? A CBS 60 Minutes report highlights a very sad and unfortunate case, where a man's freedom is taken away because of his resemblance to a perpetrator. On the night of July 28, 1984, 22-year-old Jennifer Thompson's home was invaded and she was raped. As the rapist was violating her, Thompson studied his face and tried to remember anything she could about him so that, if she lived, she could later identify him. Thompson somehow convinced the rapist to allow her to make him a drink, and that is when she escaped.
Jennifer Thompson assisted Detective Gauldin in developing the sketch of the supposed perpetrator. The sketch went out into the public, and people began to submit tips. Amidst all the tips that came in, one of those was about Ronald Cotton. Detective Gauldin later called Thompson in to do a photo lineup, where after studying each photo carefully, Thompson picked up Ronald Cotton's photo and claimed that he was the man that raped her. Thompson later picked cotton out again in a physical line-up. During this time Cotton had given his alibi to the detective, and his alibi turned out to be faulty. During a week long trial, the court heard about Cotton's false alibi, and other evidence was presented as well. Cotton seemed to own the same clothes the perpetrator wore and a piece of foam found in Thompson's home seemed to come from Cotton's shoe. All the signs seemed to be pointing to Ronald Cotton, and to the detriment of his defense, when Jennifer Thompson was asked in court if she recognized her rapist, she pointed to Cotton and said his name. 22-year-old Ronald Cotton was handcuffed and sent to prison.
One day a new inmate came in who looked very familiar. This man was Bobby Poole and he was in for rape. Cotton questioned him, asked him who he was, where he was from, and when Cotton realized the man was from the same town as he was from, Cotton asked him if he was the man that raped Jennifer Thompson. Poole denied being Thompson's rapist, but Cotton later heard from another inmate that Poole had admitted to being her rapist. Cotton was able to win a new trial and his criminal defense attorney brought Poole to the stand. But Thompson held her claim that Cotton was her rapist, and Cotton was then convicted of two life sentences. Seven years later, Cotton hears about the OJ Simpson trial and learns about DNA. Cotton wrote to his criminal defense attorney and told him he wanted another trial and wanted to be tested for DNA. The DNA testing was done and after 11 years, Cotton found himself back in court but this time he left the court a free man. The DNA tests showed that Cotton was not Thompson's rapist, but that in fact Bobby Poole was.

| Underage DUI: The Zero Tolerance Law |
| Posted By Admin |
 |
Data found on the total DUI arrests for 2008 show a total of 214,828 DUI arrests in California, and out of those 1,468 were not of the legal drinking age. Under the "Zero Tolerance Law", anyone under the age of 21 with a Blood Alcohol Content (BAC) of 0.01% or more, will be charged with a DUI. Underage drivers with a BAC of 0.05% of greater could be charged with an underage DUI and a regular DUI and is subject to arrest for a DUI. On average, to reach a BAC of 0.01% would mean you would have to drink either one 12 ounce beer, one 4 ounce glass of wine, or one 1.25 ounce of liquor. Most likely any one of these could put you over the 0.01% and closer to 0.05% BAC.
If convicted, drivers under 18 years old will loose their license for one year or until they turn 18 years old. A judge may also choose to confiscate the underage driver's vehicle. In all cases the driver will have to pay fines of several thousand dollars, and attend driver's safety and alcohol abuse related classes. Subsequent convictions will lead to harsher penalties.
Anunderage DUI is a very serious offense. Here at The Hedding Law Firm we are prepared and experienced in handling many DUI cases and we understand that your freedom is important. If you need assistance with your DUI case, call us today at (818) 986-2092. |

| 23 Year Old Man Found Guilty on Three Counts of Murder |
| Posted By Admin |
 |
|
After deliberating since Thursday, the jury returned the verdict for Andrew Gallo today. He was found guilty in the deaths of Los Angeles Angels pitcher, Nick Adenhart, and two others. He was also found guilty on other charges, including hit-and-run and driving under the influence of alcohol and causing great bodily injury.
Gallo was driving with a suspended license at the time of the crash, and his blood-alcohol level was almost three times the legal limit. In May of 2006, he had pleaded guilty to drunk driving. As part of his plea deal, Gallo had agreed that he could be charged with murder if he continued to drive drunk and killed somebody.
In California, you could be charged with a felony DUI, if someone was injured or died while you 1.) drove under the influence, 2.) either committed an additional vehicle code violation or drove in an otherwise negligent manner. Prosecutors can charge you with a felony DUI in one of three ways.
- Under California Vehicle Code 23513 VC - Driving under the influence causing injury,
- With DUI vehicular manslaughter, or
- With DUI second-degree murder
Which felony DUI you will be charged with depends on your criminal history and the unique facts of your case.
If you are facing felony DUI charges, call The Hedding Law Firm today at 818-986-2092! Our Los Angeles DUI attorneys will gather all necessary information related to your case and place every effort into your defense. |

| 9-Year-Old Son Recounts Parents' Murder, Culprit Finally Found |
| Posted By Admin |
 |
On the night of May 20, 2009, parents of Joshua Packer, Brock and Davina Husted, were stabbed to death in their home in the Faria Beach Colony, but Husteds' two children were not harmed during the attack. Brock Husted, 42, was in charge of a Santa Barbara wrought-iron business. His wife, Davina Husted, 42, was active in a women's philanthropic organization -- the National Charity League.
On the night of the murder, a gunman dressed in black -- wearing a motorcycle helmet to conceal his face -- forced the family to the ground, demanding jewelry and money. Davina Husted told her son to hand over her and Brock's wallets to the intruder. Shortly after, the boy saw his parents walk down to the back room with the intruder behind. He later heard his mother shriek and saw the killer escape. When the boy went to check on his parents he saw that they had bled profusely as well as the kitchen butcher knife that had been used to murder his parents. The boy then went to find his sister, and the two decided to escape through their parents' bathroom window to call for help.
Unsolved for almost a year, detectives were finally able to tie a culprit to the murder -- 20-year-old Jonathan Packer. Detectives were able to link him to the crime because of the DNA evidence left on a motorcycle helmet visor they found. Packer was arrested earlier this year for armed robbery of a gas station. In April he was charged robbery and burglary, as well as three counts of murder. His trial is set to take place in March.
An accusation of murder is one of the most serious charges a person can face. In California, for intentional homicide you will be facing either a first or second degree murder charge. First degree murder is when an intentional death results due to malice aforethought, premeditation, on the part of the killer. Second degree murder is a homicide that is intentional, without malice or premeditation, and takes place in the heat of passion, such as in a domestic violence situation. Both 1st and 2nd degree murders are felony offenses in the state of California and will be punished severely.
Your constitutional rights are very important to us! We will fight to obtain the best outcome for your particular case. Contact a lawyer at the Hedding Law Firm today for a free consultation regarding your murder case.

Roberts was charged with alleged acts against his wife, an alleged mistress and another man while serving as an officer with the police department. Superior Court Judge Richard J. Beacom decided to move forward with the case once he had heard testimony from Roberts' ex-wife and Orange County investigators, upholding 19 of the 20 felony charges filed by prosecutors. | 'Sons of Anarchy' Actor, Mark Hiedrich, Arrested for Battery and Resisting Arrest |
| Posted By Admin |
 |
55-year-old "Sons of Anarchy" actor. Mark Hiedrich (known as Mark Boone Junior on the show) was arrested after resisting a police officer. The officer pulled Hiedrich over in his 1995 Ford Thunderbird for not wearing a seatbelt and using his cellphone while driving. Sources say that the actor was apparently in a rush. As the officer attempted to handcuff Hiedrich, Hiedrich resisted, leaving the officer on the ground. While resisting, the actor attempted -- but missed -- to punch the officer in the face. Sources say that the police officer was unfazed and unscathed after the altercation. On Tuesday at approximately 4:40 p.m. Hiedrich was put into custody for two misdemeanors: battery on a peace officer and resisting arrest.

On Wednesday, the notorious 56-year-old former Bell city manager, Robert Rizzo, plead guilty to driving under the influence of alcohol. His infamous claim to fame came when his $800,000 salary was revealed by The Times, resigning from his position in July. On March 6, Rizzo was arrested after attempting to drive into his driveway, and plowing through his neighbor's mailbox instead. Rizzo, was said to have had a blood-alcohol level three times the legal limit at 0.28. Officers stated that he was so inebriated that they could not immediately test his blood-alcohol level, or comprehend his slurred speech. Rizzo, who originally did not plead guilty, did so on Wednesday through his attorney. The former city manager was sentenced to 10 days of community service and a nine-month first-offender alcohol awareness program.

While De Silva's husband exited the Prius to go open a driveway, De Silva exited the car to check up on their grandson. It was then that the marine, driving a Jeep Cherokee, rammed into the rear-end of the Prius. De Silva was killed instantly, and her grandson -- who suffered from lacerations and force trauma to the body -- was flown the Children's Hospital in Los Angeles. | New Program Puts Ignition Interlock In Cars Of DUI Offenders |
| Posted By Admin |
 |
A new program was set on July 1, mandating that those who have been convicted of DUI will need to install a new breath alcohol ignition interlock device in their cars. Drivers will need to blow into a tube attached to said device, which in turn traces and calculates his or her blood-alcohol level. This pilot program requires a blood-alcohol concentration of at most 0.03, even-though California's legal limit is 0.08. Anything exceeding the 0.03 limit would prevent the vehicle from turning on. This program will run in Sacramento, Tulare, and Alameda counties until the year 2016.
Those convicted of DUI for their first time would be required to use the device for about half a year. Those convicted a second time would leave the device installed for a year. Sources suggest that the cost of these devices would run around $125: $75 to install the ignition interlock device and approximately $50 a month to monitor. Offenders struggling to pay the full amount would simply pay less. Also, authorities maintain that this would not use up any taxpayer money.
DUI offenses are among the most common crimes police officers arrest Californians for on a daily basis. Many people do not realize that a DUI is a crime that carries potentially serious consequences to the person's driving record, insurance rates, reputation and freedom. At the Hedding Law Firm, we diligently and professionally defend individuals charged with drunk driving. Our lawyers have handled hundreds of DUI / DWI cases over the years and we know the appropriate steps to take to assist you in making the right decisions. A jury convicted Suzanne Amelia Carlson, 27, of second-degree murder. Carlson was sentenced 15 years to life in prison after she rear-ended a truck and killed a passenger; she was inebriated while driving on the 91 Freeway.
In court, witnesses testified that Carlson had been drinking at a restaurant for approximately two hours. Shortly after Carlson drove a man's sedan; he sat in the passenger seat of his car. As she entered the 91 Freeway, she rear ended the back of a FedEx truck, destroying the right side of the sedan. Carlson escaped through the sunroof, but her passenger remained stuck inside. An attempt was made to remove the passenger, but he was unable to overcome the internal injuries that he sustained.
Testing revealed that Carlson drove with a BAC (blood alcohol level) of 0.22, which is about three times that of the legal limit. Perhaps the most troubling prospect of all is Carlson's record: she had been convicted of three other DUIs in the past, forced to take alcohol-awareness courses.

Chatman, who claimed that Knight threatened to kill him. The Los Angeles Superior Court Judge, Carol Boas Goodson, ordered that Knight needs to stay 100 yards away from the rapper and his family.

Juan-Carlos Cruz, most commonly known as a Food Network personality, was charged on Monday with solicitation to commit murder and attempted murder. Prosecutors allege that Cruz asked at least two Santa Monica homeless to kill his wife in exchange for money. His co-workers and neighbors described him as a community volunteer, dedicated churchgoer, and loving husband.
Santa Monica police detectives went undercover for a weeklong investigation until they arrested Cruz. The authorities learned of Cruz's plot when one of the homeless men he solicited told the Santa Monica police. Cruz is said to have had provided the homeless with a weapon and cellphone. Other sources later said that he wanted one of the homeless men to strangle his wife.
Cruz had his first court appearance in the Los Angeles County Superior Court where he pleaded not guilty. If he is found guilty he could be facing a life term in prison.
